Sec. 14-1-1.    Duty to keep sidewalk clean.

From and after the enactment of this Chapter XIV, Section I, it shall be the duty of any person or persons actually occupying or using premises as owner, lessee or tenant thereof, within the corporate limits of the Town, to keep the public sidewalk contiguous to the premises and grounds so occupied or used free and clear of all snow and ice, and it shall be the duty of such person or persons to remove all snow from said sidewalks within twenty-four (24) hours after the same has fallen.  (Ord. 114 §1, 1914)


Sec. 14-1-2.    Owner of adjacent property to keep sidewalk clean.

Where any premises, or parts of premises, within the limits of said Town are not occupied as aforesaid, then it shall be the duty of the owner to comply with the requirements of the foregoing Section; provided that, in the event said owner shall be a nonresident or absent from said Town, then any resident, agent or representative of said owner having charge of said premises shall be liable under the provisions of this Chapter XIV, Section I.  (Ord. 114 §2, 1914)


Sec. 14-1-3.    Penalty for violation.

Any such occupant, owner or person who shall fail to comply with the provisions of this Chapter XIV, Section I, or any of them, shall, upon conviction thereof, be fined in a sum not less than one dollar ($1.00), nor more than twenty-five dollars ($25.00).  (Ord. 114 §3, 1914)


Sec. 14-1-4.    Civil liability.

The owner or owners of property adjacent to Town sidewalks shall be responsible for maintaining the sidewalks clear of any ice or snow.  Any civil liability arising from the failure to remove ice and/or snow from the sidewalks shall be imposed on the owner or owners of the property contiguous to such sidewalks.  (Ord. 406 Section 1, 1988)
